Case we’re discussing…

A High Court case decided in the UK this week involving a transgender man will no doubt be cited in future Australian cases. Freddy McConnell was born a female but later transitioned to become a male. He retained his female reproductive system and became pregnant via intrauterine insemination from a sperm donor.

Upon birth, he sought to register himself as a “father” of the child on the birth certificate but was refused. McConnell appealed but the President of the High Court’s Family Division found that “motherhood” related to the person’s biological role in the process of being pregnant and giving birth and as such McConnell must be registered as the child’s mother; despite social and psychological reality of his relationship with the child.
